What reason would a custody hearing be heard in superior court instead of family court?

How could a lawyer get a hearing set up in superior court instead of family court between two people who have been divorced more than 5 years?

    When the Family Court loses jurisdiction, the Superior Court can assume jurisdiction of a case under the Rules of Court.
